Proposed legislation in California could exempt certain reactor designs from the state’s long-standing moratorium on new nuclear generation, effectively ending the moratorium.

California Assembly Member Lisa Calderon (D., 56th Dist.) filed A.B. 2647 with the California State Assembly last week.

If the bill progresses and becomes state law, it could pave the way to increasing the number of nuclear reactors in the state in the future. Currently, Diablo Canyon nuclear power plant houses the only operational commercial nuclear reactors in California.

Fedorchak

North Dakota’s sole member of the U.S. House of Representatives, Republican freshman Congresswoman Julie Fedorchak, has introduced the Baseload Reliability Protection Act.

The bill aims to “amend the Federal Power Act to prohibit retirements of baseload electric generating units in any area that is served by a Regional Transmission Organization or an Independent System Operator and that the North American Electric Reliability Corporation [NERC] categorizes as at elevated risk or high risk of electricity supply shortfalls, and for other purposes.”

Amendments: The Baseload Reliability Protection Act would amend the Federal Power Act in the following ways:

A bill that would create a nuclear energy task force in Delaware has passed the state Senate and is now being considered in the House of Representatives.

Colorado Gov. Jared Polis signed a bill into law on Monday that adds nuclear to the state’s clean energy portfolio—making nuclear power eligible for new sources of project financing at the state, county, and city levels.

The final passage of Senate Bill 424 from Indiana’s House of Representatives last week sent a key piece of pronuclear legislation to Gov. Mike Braun for final approval.

The legislation offers public utilities that want to develop small modular reactors in the Hoosier State to recover preconstruction costs from their customers before the project even begins. The company would have to petition the Indiana Utility Regulatory Commission and, if approved, would have the opportunity to establish a new rate that reflects the cost of the project.

Pronuclear coalition Nuclear Matters is asking people to help preserve nuclear power and support new technology by writing to members of Congress.

DeWine

State legislation that designates nuclear power as “green energy” and expands oil/natural gas hydraulic fracturing (fracking) leases on state land was forwarded this week to the desk of Ohio Gov. Mike DeWine. The Republican governor has 10 days after receiving House Bill 308 to either sign it into law or veto it. A “green” designation would imply state recognition that nuclear energy causes no harm to the natural environment.

Pro arguments: In its coverage of the bill, Spectrum News quoted Greg Lawson, a research fellow at the Buckeye Institute, as defending nuclear energy. “Nuclear energy is zero carbon emission, and from that standpoint, it certainly addresses a lot of the concerns that folks have when they’re concerned about what happens to the climate. . . . Right now, Ohio is facing a real challenge. We’ve got a lot of data centers coming into Ohio. This is a massive issue. These things consume just incredible amounts of electricity,” Lawson said.

Fleischmann

Two U.S. representatives—Chuck Fleischmann (R., Tenn.) and Byron Donalds (R., Fla.)—have published an op-ed in the Washington Examiner that calls for the United States to seize “the current nuclear economic opportunity worldwide” and “once again be the world leader in nuclear power.” The congressmen emphasize that “it is in the best interest of the United States and the rest of the world for our country, instead of China and Russia, to be the preferred partner for embarking nuclear nations.”

Atoms for Peace: Fleischmann and Donalds argue that President Dwight Eisenhower’s “Atoms for Peace” speech in 1953 established the foundational principles for the domestic and global success of the U.S. civil nuclear energy industry—and they urge the nation to reclaim those principles now. They point to the numerous benefits of nuclear energy, ranging from economic development to desalination to sustainable fuel creation, and note that the “global market is ripe for nuclear technology.”

This year has been a good one so far regarding interest from state legislatures in the potential of nuclear energy. Examples reported by Nuclear Newswire include, in January, an Indiana bill to incentivize the construction of small modular reactors, and this month, West Virginia’s repeal of its ban on new nuclear plant construction and legislation in Illinois aimed at achieving the same end in that state. Slipping under our radar until now, however, is a measure in Oklahoma introduced earlier this month that would create a feasibility study to examine the possibility of nuclear power in the Sooner State.

The American Nuclear Society was among 24 nuclear-related companies and organizations that signed a letter urging Senate sponsors of the American Nuclear Infrastructure Act (ANIA) to reintroduce and advance the legislation. The signees represent a broad range of nuclear supporters from the industrial, nonprofit, and advocacy sectors. The letter was sent to Sens. Shelley Moore Capito (R., W.Va.), Mike Crapo (R., Idaho), John Barrasso (R., Wyo.), Cory Booker (D., N.J.), and Sheldon Whitehouse (D., R.I.). Barrasso was the original sponsor of the bill, while Whitehouse, Crapo, and Booker were original cosponsors.

A group of Republican senators on March 2 penned a letter to Nuclear Regulatory Commission Chairman Kristine Svinicki to express their support for the ROP Enhancement Initiative—an effort to assess and modernize the agency’s nuclear safety inspection program, better known as the Reactor Oversight Process. The letter was signed by Sens. John Barrasso (R., Wyo.), chairman of the Senate Committee on Environment and Public Works; Jim Inhofe (R., Okla.); Shelley Moore Capito (R., W.Va.); Kevin Cramer (R., N.D.); Mike Braun (R., Ind.); Mike Rounds (R., S.D.); John Boozman (R., Ark.); and Roger Wicker (R., Miss.).

On February 27, Sens. Lisa Murkowski (R., Alaska) and Joe Manchin (D., W.Va.) introduced the American Energy Innovation Act (AEIA), a 555-­page piece of policy legislation that incorporates over 50 energy-­related bills considered and individually reported by the Senate Energy and Natural Resources Committee last year—measures sponsored or cosponsored by more than 60 senators from both sides of the aisle.
