The Nuclear Regulatory Commission and the U.S. Department of Justice are asking the 5th U.S. Circuit Court of Appeals to review its decision to vacate Interim Storage Partners’ license to build and operate a consolidated interim storage facility (CISF) for commercial spent nuclear fuel in Andrews County, Texas.

The Nuclear Regulatory Commission has approved the transfer of the operating licenses for four reactors and their associated spent fuel storage facilities from Energy Harbor Nuclear Corporation to Vistra Operations Company, the agency announced September 29.

The Department Justice earlier this week filed comments with the Federal Energy Regulatory Commission regarding Vistra Corporation’s proposed acquisition of Energy Harbor, the Ohio-based owner and operator of the Beaver Valley, Davis-Besse, and Perry nuclear plants. Echoing misgivings raised in June by PJM Interconnection’s market monitor Monitoring Analytics regarding the possible exercise of undue market power as a result of the deal, the DOJ Antitrust Division’s 16-page document urges FERC to carefully review the proposal to ensure it will not substantially lessen competition and increase wholesale electricity prices in the PJM region.

The Department of Justice recently unsealed an indictment charging three Russian nationals with attempting, supporting, and conducting computer intrusions that targeted the global energy sector between 2012 and 2017. One of the targets was Wolf Creek Nuclear Operating Corporation, operator of the single-unit 1200-MWe Wolf Creek nuclear plant near Burlington, Kans.

A former senior resident inspector for the Nuclear Regulatory Commission pleaded guilty on December 13 in the U.S. District Court for the Western District of Virginia to making false statements on NRC inspection reports. Such false statements violate federal statutes and carry a maximum penalty of five years in prison.
