Court Delays Decision on Stay of Clean Power Plan

According to a report  in Politico today, the D.C. Circuit Court of Appeals agreed with the EPA's suggestion to delay a decision on a stay of the Clean Power Plan until after the COP21 Paris climate talks end.

The three judges agreed to the EPA's proposed briefing schedule on requests to stay the rule that would end on December 23.  It is expected that any decision on whether to approve the stay requests will not come until after COP21 ends on December 11.

Five stay requests have been filed to date, and will be consolidated.
